Handing things over informally
Property released without a signed receipt against the original inventory leaves the representative exposed all over again. Six months later a beneficiary says they never received the watch, and the representative — who did hand it over — has nothing to show.
How release should work
- Only on documented authority from the representative.
- Item by item against the original inventory.
- Signed receipt from the person receiving it.
- Photographs at release where the item is significant.
- The record closed out and provided to the representative.
How we handle it

- 05Provide the closed record to the representative and to counsel.
Release in tranches as distributions are agreed rather than all at once. It is administratively slightly more work and it produces a much cleaner record, because each release is tied to a specific decision.

We release to whoever the representative documents, and we do not adjudicate whether that instruction is correct. If a beneficiary disputes a distribution, that is a matter for the representative and the court.

- Can a beneficiary collect directly?
- Yes, where the representative documents the authority. They sign a receipt against the inventory.
- What if a beneficiary later says they got nothing?
- The signed receipt answers it, which is exactly why we take one.
- Can we release in stages?
- Yes, and it usually produces a cleaner record than a single handover.
- What happens to the record afterwards?
- Closed out and provided to the representative and anyone they name.
